Collaborative Law is a process in which the couple works with several professionals in order to navigate through the divorce process together and come to mutual agreements and understandings. Both spouses will be represented by their own attorneys; however, as opposed to a contested process, the parties will also share a joint financial professional and a mental health professional in the process. These four professionals, with the couple, make up the body of the Collaborative Team. This process enables the parties to reach a settlement that best meets the specific needs of both parties and their children, if applicable, without the underlying threat of litigation. It is a process which helps prevent animosity between the parties as they are working together towards a common goal.
As part of this process, both parties and their attorneys sign a collaborative participation agreement that sets forth the nature and scope of the matter. The parties voluntarily provide all relevant information to one another without the need for the formal discovery process. The parties and the rest of the Collaborative Team use team meetings to work towards amicable resolutions in the matter. The goal of the Collaborative process is to enter into a written settlement agreement which address all issues between the parties. Should the process be unsuccessful, the professionals must be discharged and the parties must then begin a contested proceeding.
